These Terms of Service (“Terms”) govern your access to and use of the ZEVcentric website and your purchase of products or services from R G Enterprises, Inc. d/b/a ZEVcentric (“ZEVcentric,” “we,” “us,” or “our”).

By accessing this website, placing an order, scheduling a service, or otherwise using our services, you agree to these Terms and to any additional policies or terms referenced below.

1. Online Store Terms

You may use this website only for lawful purposes and in accordance with these Terms.

You may not use our products, services, website, or content for any unlawful or unauthorized purpose, nor may you violate any applicable law in connection with your use of the website.

You may not transmit malicious code, interfere with the operation or security of the website, attempt unauthorized access to any system, or misuse the website in a manner that could damage ZEVcentric or another party.

2. Product Information

We make reasonable efforts to provide accurate product descriptions, fitment information, pricing, specifications, photographs, availability, and lead-time information.

However, vehicle configurations, manufacturer specifications, product designs, availability, and other information may change. Customers are responsible for reviewing product details and confirming suitability for their intended application before installation or use.

Photographs, colors, finishes, and product appearance may vary due to lighting, display settings, manufacturing changes, or other factors.

3. Vehicle Fitment and Modification

Many products sold by ZEVcentric are intended for modified, performance, motorsport, off-road, suspension, wheel, tire, braking, alignment, or vehicle-fitment applications.

Vehicle modifications can affect handling, ride quality, tire wear, ground clearance, alignment, braking, warranty coverage, legality, safety systems, and other vehicle characteristics.

Customers are responsible for confirming that any product or modification is appropriate and legal for their vehicle, intended use, and jurisdiction.

Professional installation, inspection, alignment, recalibration, or other service may be required depending on the product and application.

4. Orders and Acceptance

Submitting an order does not guarantee acceptance of the order.

ZEVcentric may refuse, limit, cancel, or place an order on hold when reasonably necessary, including for suspected fraud, payment verification, product unavailability, incorrect pricing, incorrect product information, shipping restrictions, or other legitimate business reasons.

If an order is cancelled by ZEVcentric after payment has been collected, the applicable amount will be refunded to the original payment method, subject to any lawful and applicable deductions associated with an authorized cancellation or return.

5. Pricing and Errors

Prices, specifications, promotions, availability, and product information may change without notice.

If an order is placed using an incorrect, outdated, or clearly erroneous price, ZEVcentric may pause processing and contact the customer before proceeding.

When appropriate, the customer may accept the corrected price or cancel the affected item without the normal cancellation fee.

6. Payment

Customers agree to provide current, complete, and accurate purchase and account information.

Payment processing may be provided by Shopify or other third-party payment providers. Use of those payment services may also be subject to the provider's applicable terms and privacy practices.

ZEVcentric may require additional identity, billing-address, shipping-address, or payment verification before processing an order.

7. Special-Order and Made-to-Order Products

Many products sold by ZEVcentric are special-order, made-to-order, imported, manufactured, configured, finished, or sourced specifically for an individual customer or vehicle application.

When a product page states that an item is Special Order, Made to Order, Cannot Be Cancelled, Non-Returnable, or uses similar language, those terms form part of the customer's purchase agreement.

Lead times are estimates unless ZEVcentric expressly confirms a guaranteed delivery date in writing. Manufacturing, freight, customs, supply-chain, and other circumstances outside our reasonable control may affect estimated delivery timing.

Cancellation and return eligibility for special-order products is governed by our current Refund Policy and any product-specific terms disclosed at the time of purchase.

8. Returns, Refunds and Cancellations

Returns, refunds, order cancellations, restocking fees, refused shipments, special-order restrictions, and related matters are governed by our current Refund Policy.

The Refund Policy forms part of these Terms and applies to purchases from ZEVcentric.

9. Shipping and Delivery

Shipping methods, carrier practices, delivery estimates, shipping damage, international shipments, refused shipments, freight, tracking, and related matters are governed by our current Shipping Policy.

The Shipping Policy forms part of these Terms and applies to orders requiring shipment.

10. Installation and Service Appointments

ZEVcentric provides certain installation, alignment, inspection, suspension, fitment, and other automotive services by appointment.

Service packages may include parts, labor, alignment, taxes, or other items as specifically described on the applicable product or service page.

Customers are responsible for providing accurate vehicle information, including year, make, model, trim, drivetrain, wheel and tire configuration, suspension modifications, and other relevant information when requested.

Additional labor or parts may be required if previously undisclosed modifications, damaged components, seized hardware, incorrect parts, unsafe conditions, or other unexpected conditions are discovered during service.

Where additional charges are reasonably necessary, ZEVcentric will attempt to obtain customer authorization before performing work beyond the agreed scope.

11. Appointment Deposits and Rescheduling

Service appointments may require a scheduling deposit.

Unless otherwise stated on the applicable service page, appointment deposits, cancellation rules, rescheduling requirements, and related service terms are governed by the current Refund Policy and any service-specific terms presented at the time of booking.

12. Customer-Supplied Parts

ZEVcentric may, at its discretion, decline to install customer-supplied parts or products that we believe are incorrect, unsafe, damaged, incomplete, counterfeit, unsuitable, or otherwise inappropriate for the requested application.

Any warranty responsibility for customer-supplied parts remains with the seller or manufacturer unless expressly agreed otherwise in writing by ZEVcentric.

13. Manufacturer Warranties

Many products sold by ZEVcentric are covered by warranties provided by their respective manufacturers.

Warranty terms, exclusions, procedures, and remedies vary by manufacturer. ZEVcentric may assist with manufacturer warranty claims where appropriate, but the manufacturer generally determines whether a product qualifies for repair, replacement, credit, or another remedy.

ZEVcentric does not extend or modify a manufacturer's warranty unless expressly stated in writing.

14. Motorsport and Performance Use

Certain products may be intended for performance driving, competition, motorsport, off-road use, or other demanding applications.

Motorsport and high-performance driving involve inherent risks and may accelerate wear or cause damage to vehicle components.

Customers assume responsibility for the proper inspection, maintenance, preparation, and operation of their vehicles.

15. Intellectual Property

All website content, including text, photographs, graphics, logos, video, design elements, product descriptions, technical materials, and other content owned by or licensed to ZEVcentric is protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, publish, commercially exploit, or otherwise use our content without prior written permission except as permitted by law.

16. User-Submitted Content

If you submit reviews, photographs, vehicle-build information, comments, videos, testimonials, or other materials to ZEVcentric, you represent that you have the right to provide that content and that it does not violate the rights of another party.

Unless otherwise agreed in writing, by submitting content for publication you grant ZEVcentric a non-exclusive, worldwide, royalty-free license to use, reproduce, display, edit, and publish that content in connection with our website, social media, marketing, educational materials, and business operations.

You may contact us if you wish to request that customer-submitted content be removed from future use, although previously published or distributed materials may not always be capable of complete withdrawal.

17. Third-Party Tools and Links

Our website may use or link to third-party services, applications, payment processors, social-media platforms, manufacturers, shipping providers, or other websites.

We are not responsible for the availability, content, security, policies, products, or practices of independent third parties.

Your use of third-party services is subject to their applicable terms and policies.

18. Disclaimer of Warranties

Except for warranties expressly stated by ZEVcentric or an applicable manufacturer, and to the fullest extent permitted by law, this website and its content are provided on an “as is” and “as available” basis.

ZEVcentric disclaims implied warranties to the extent such disclaimers are permitted by applicable law.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

19. Limitation of Liability

To the fullest extent permitted by law, R G Enterprises, Inc. d/b/a ZEVcentric and its officers, directors, employees, agents, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or products or services purchased through it.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply to you.

20. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless R G Enterprises, Inc. d/b/a ZEVcentric and its officers, directors, employees, agents, affiliates, suppliers, and service providers from claims, liabilities, damages, losses, expenses, and reasonable attorneys' fees arising from your unlawful use of the website, violation of these Terms, or violation of another party's rights.

22. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where otherwise required by applicable law.

To the extent permitted by applicable law, any legal proceeding directly or indirectly arising out of or relating to these Terms, this website, or purchases from ZEVcentric shall be brought in the applicable state or federal courts located in Alameda County, California.

23. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

24. No Waiver

ZEVcentric's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

We may update these Terms from time to time to reflect changes in our business, products, services, website, technology, or legal requirements.
